Unfortunately, disputes and conflict are an unavoidable part of life. Disputes can and do occur across a large range of areas including:
Disputes with builders;
Disputes between family members;
Disputes over the terms of a will;
Disputes over loans;
Disputes with respect to insurance;
disputes involving proceedings in a court or tribunal which may often involve a number of parties and complex issues.
We are experienced in the area of dispute resolution and mediation. Our principal, Mario Merlo, is a Law Institute of Victoria accredited mediator and a Law Institute of Victoria accredited specialist in commercial litigation and has been involved in hundreds of mediations throughout his extensive career as a solicitor.
Mediation is a dynamic, structured, interactive process where an impartial third party – the mediator – assists the disputing parties in resolving their conflict through the use of specialised communication and negotiation techniques. All participants in mediation are encouraged to actively participate in the process. Mediation is a process that is focused primarily upon the needs, rights and interests of the parties. The mediator guides the process in a constructive direction and helps the parties find the optimal solution. Mediation is aimed at achieving resolution of disputes or conflict in order to minimise the costs incurred by the parties.
We work hard to bring about a resolution to every dispute and to ensure that all parties are satisfied with the process.
